Which they can do, Publisher or not. You agree to it before you can even sign up. Your only recourse is to...sign-out and have your account deleted and not use the service...I guess?

That's not a publisher issue and it is not a libel issue. It's a ToS issue and you agree that these things are okay when you agree to the ToS. It sucks, for sure. But it's just what you have to accept if you choose to use their service.
