You see, anytime anyone takes any amount of $10k or over out of the bank the bank is required to report the action to the feds (perhaps it helps them catch drug dealers and robbers I guess?). So, if you take $9,999.99 out of the bank it is not reported.

The feds case against Hovind was that he got around his large withdrawals that he routinely took out from being reported by only taking out a few thousand at a time over a short time period. So, it ended-up being well more than $10k total that he withdrew. However, he, like most people still are, was completely ignorant of that particular law and so didn't realize he was engaging in "structuring" activity.

Sorry, man, but Hovind knew what he was doing. No one in their right mind would believe the Hovind wasn't trying to skirt around the financial laws that prevents money laundering.

If you're interested in the actual details of his crimes and how he clearly and knowingly broke the law in many different ways, Forbes (a slight right leaning money, business, and economics media organization) does a great job of breaking down the entire case, Hovind's terrible defense arguments, and all the laws that are at play for this whole situation.

The basics of it are:

He clearly had 40+ employees that he pretended were contractors to get out of taxes.

He made 45 withdrawals around $9,500 each to avoid the $10,000 trigger. That's 45 withrdrawals. Two or three times, you can claim innocence. Maybe even 5 is coincidence. But 10 times? Nah, no way. 20? You're clearly gaming the system and you'll be caught. 30 times? You're a dumbass. You will clearly be caught and your case will be high profile.

40+ times? You're doing all of this on purpose and are hoping to be a matyr or you are so delusional that you think God will save you from committing clear crimes. Hovind is this type: so delusional that he thinks committing clear crimes like this will be ignored because God will save him. He even openly talked about being a Sovereign Citizen and the law had no jurisdiction over him. Flagrant abuse of money systems to avoid taxes and reporting.

If Hovind had an actual case, then how he spent that money would be clearly applied in purchases shortly after withdrawing the money which was suspiciously right below the reporting limit. He didn't. Hovind knew he didn't have a case. So his argument was "separation of church and state" to say the IRS didn't have power or authority over him. Only problem with that defense: he clearly made structured withdrawals to avoid the tax laws that would have gotten him in trouble with the IRS. If the IRS had no power over him, why did he make withdrawals to avoid the ire of the IRS? Seems his defense was doomed before he could make it.

He called his employees "missionaries" to avoid the contractor designation.

But here's the final nail in the coffin for Hovind's case: he made and sold videos about taxes and how to avoid them. They were tax-protestor videos. If he really was ignorant and didn't intentionally structure his withdrawals, then how do you explain his tax-advice and tax-protestor videos where he shows clear working knowledge of the tax system?

This is why the jury didn't buy his bullshit. This is why his appeals failed.

It has nothing to do with any conspiracy theory related to his anti-evolution positions. That's a red-herring he is using to get his followers, fans, and supporters not to have to acknowledge the fact that he committed tax fraud of epic proportions, quite flagrantly.

I think Hovind is smart as hell and quite entertaining. That doesn't mean I can't acknowledge the fact that he is a criminal who clearly broke the law to avoid taxes. Avarice is a sin. He let avarice rule his judgement and he paid the price for it.

Bingo.

IMO, it's a shame he didn't get a longer sentence.

The official reason was "breaking 'structuring laws'" which are probably the dumbest laws ever made but the real reason was for the video of his contained in the link below:

https://www.youtube.com/watch?v=m-tY17NaXiQ&t=4204s

In Hovind's own words (paraphrased, at least): A Swat team with guns drawn broke down the doors to his house one morning while he and his wife were still in bed sleeping, dragged him to the floor w/guns pointing at him, and demanded he hand over his seminar video that exposes the dangers of evolutionary teaching and how it is the overriding philosophy in Naziism, communism, racism, and socialism. It is the exact same video contained in the link above.

*Eyes narrow* Those facist bastards.

@DDD: your apology is not needed because I was right about every single thing I said. Sorry, I'm not reading your huge wall of text.

Hovind was officially imprisoned for "structuring" and only structuring. That is a fact. I admit that what I said about the real reason being because he made that video exposing the dangers of evolution is based on my and his (and many other people's) opinion though. Not sure if that was actually the real reason or not. It was weird how they were demanding he hand over all copies of that particular video though and the way they treated him for such breaking such an obscure law. That was massive overkill. It reminds me of how swat teams treated Roger Stone for supposedly committing the crime of "lying to congress". That treatment was unnecessary especially for someone who had no former record.

FFS, just read the transcript of what the atheist judge said to Hovind before she sentenced him to ten years in prison. It was pretty obvious to me the man was railroaded. She told him that his "crime" (of taking his own damn money out of the bank) was "worse than rape." LOL. It was clear to me the government had a burning desire to remove the man who was being so effective at exposing the dangers and lies of darwinian evolution. Hovind, is one of, if not THE most well-known and influential biblical creationists.

Hell, Jeffrey Dahmer, the mass murdering cannibal, was spiritually saved before he was killed in prison by other inmates as a direct result of watching Hovind's creation seminar videos. He admitted on camera w/his dad setting next to him (who got him the videos to watch while he was in prison) that his beliefs in darwinian evolution played a huge role in him committing the heinous crimes he did. Hovind said he saved lots of people while in prison. He thinks God used him to save so many souls because of his wrongful conviction. I think he may be right.

Back in the day, you'd get a ban for this by Ush. lol

If you create a thread with no intent to discuss the thread topic and only to fight certain posters, you'd get banned for trolling.

Since you don't want to address the specifics of his case and the actual crimes he committed, there is not point to this thread.

Sorry, I meant 'serial killer' not mass murderer but my points still stand.

In this short video, which was made shortly after he got out of prison, Hovind discusses being sent to prison for "structuring."
