What paths has madara used besides absorption? And I only recall that happening once so he wouldn't be owned by Naruto.
I also think the circumstances are different in tobi's case. he is using crazy chakra to resurrect the Juubi i assume, as well as the chakra he has already used to control the tailed beasts. his doesn't regen like madara's. Plus absorbing one attack leaves him open to whatever the other characters want to hit him with. not something you really want to have happen when 2 of your enemies can hurl bijuudamas at you. i think Tobi honestly has the tougher fight, mostly because of naruto and Kakashi.
