Actually there was a study a few years back that said, generally the female brain has a relatively higher level of analytical capacity, and the ability to be "more intelligent" then their male counterparts.
Also, here in Australia, at most universities there are a higher % of female students. Likewise, more men/boys drop out then females. Likewise at my high school a couple of years back, and a number of other High schools I know about, the top classes saw the girls form the majority, not by much, but still.
As far as I know this is not isolated to Australia.

well, the thing is, that in percantage more women do get cheated when it comes to promotion and wages than men, which really does make it more likely that the percentage of women winning law suits is higher than the percentage of men ditto. I really don't think many companies choose a less qualified woman over a better qualified man, where they might be likely to choose a less qualified man over a better qualified woman. I'm not saying that it never happens in the case of men, I just don't think it happens very often. not very often at all.
but the reason IS solely due to gender. if you look at the statistics they'll tell you the same; men get better wages than equally qualified women, men get more promotions than equally qualified women. this in itself is a reason to stay a little sceptical and suspicious, but of course not in a completely destructive manner. also, while I have no doubt that the statistics are due to quite a few old fashioned work places, there's no doubt either that women could do a lot themselves to improve their situation, such as not being so darn polite all the time, but really make the boss aware of their good qualification, which most men have no preblems doing. in that way, being suspicious isn't the entire solution.

You could have just said "Glass Ceiling" and saved yourself a whole paragraph and a half.
(Glass Ceiling = the upper limit of wages for women, often lower than those of men due to gender discrimination)
Then again, men don't have hot flashes, mood swings to to monthly fluctuations in hormone levels, etc; I'm not saying it's something I'd justify as a reason to dock pay, but it might offer some insight as to why someone might.

but my point is that some women who aren't as qualified will still go to court, and win... thats what annoys me...

studies have shown that men normally get higher test scores, but its because for the most part women are very much more analytical than men, and we tend to second guess ourselves more often than not.
Neither one is smarter, just intelligent in different ways. sort of like the left brain, right brain type of thinking theory.
however, although studies have also shown that there are more men college students in the US than women,
but more women actually FINISH college than men. which means that men have a higher college dropout rate than women.
So it's a toss up basically

I agree that it shouldn't be possible winning such a case without good evidence that you were actually being discriminated against.

if both candidates are equally qualified for the job, I guess what I'd look at ( should I ever find my self in such a privileged situation 😄 ), would be, a: is there an over representation of one particular gender among the emplyees? in that case, I'd try to even that out, and/or b: who of the two candidates seem to be a person, whom I, and everybody else, would get along with the best, so yes, in other words; the one I like the best and think everybody else'd like the best.
