The "person" within the vicinity of the Hogyoku must possess the power to begin with.
Meaning...they have to have the ability for the Hogyoku to "grant" them that desire. You can't wish, for instance, to have something materialize. You can, however, wish for your latent fullbring powers to be brought to the surface (Inoue and Chad).

The Soul Society was prepared to kill Rukia for giving powers to a human. What Aizen was doing was a thousand times worse than that and clearly should've been given the death penalty but instead was sealed up by Kisuke and was thrown into a prison. Now why would they only do that to him? Maybe it's because he can't be killed 😐
I thought it was stated somewhere that he couldn't be killed.
Well even immortals can feel pain I believe. Having a taste of Yamamoto's flames would not be pleasent to anyone.

It states it when they are sentencing Aizen. They say that since he's immortal, he goes to the lowest level of the maggots nest.
It does say it but it doesn't make any sense why he is immortal. If he is, nothing could pose a threat to him. He wouldn't need Wonderweiss if that were the case.

So Aizen has had the power all along to absorb Yamamoto's flames and create Arrancars? Because that is what he desires and what the thing does for him. Along with granting him immortality apparently.

No, Wonderweiss had that ability, not Aizen. WW had the ability to seal Yamamoto's powers and that's why Aizen chose him. He sacrificed all of his intellect to make that power strong enough.
Aizen used the crystal to facilitate that desire. You MUST have the power in order for the crystal to use it.
Also, the alternative explanation is, yes, Aizen did have the latent power but it wasn't strong enough. He had to embue that power into something that was strong enough.
