If they're teaching it in a public school, then it's just as illegal as teaching someone about Evolution. Or at least, teaching evolution as if it were certainty.

Evolution is part of science though, its real. Everything evolves from the past...not just humans.

I hope you're not serious. Public schools are not run by "the church" or any church. Remember separation of church and state? Also, after the Russian's Sputnik came about in the 60's, America realized how behind it was as far as science was concerned and started including evolution in public schools. There were a couple states that passed state laws to force the teaching of creationism in place of evolution but those laws were later ruled unconstitutional in the Supreme Court. My public school taught evolution.
