Writers are the ones that shouldn't be reviewing it anyway they jack up their own comics, fans keep more continuity then writers do.
Regardless its marvel, its legitimate and time to move on to the next discussion of this fight and not so much the strength aspect which has been shown from the MARVEL source.

While I agree that Wolvie and Cap's fighting skills are equal, I seriously doubt that Wolverine knows every fighting style on the planet. The only place that that has been mentioned, is in the handbooks, and they didn't even say "every style" The said VIRTUALLY every style. Wolverine has never shown to demonstrate the kind of wide variety of skills to consider him on that level. I mean really, "every fighting style on the planet?" He's demonstrated a few martial arts that he uses consistantly, but never shows to have knowledge of every style. He's shown some kind of ju-jitsu, wrestling, tae-kwon-do kicks, judo, and some times the occasional sword style. Other than that, he hasn't demonstrated much else. 100 years of training is not enough to learn all the styles anyway. Has he learned Baranta? That's a Hungarian martial art. Do you think he's been to Hungary to master that style??? While I put him on the level of Cap's in terms of fighting, he doesn't know every style on the planet. Saying that is just Marvel's way of saying "he's such an uber martial artist, that you'll never be able to get on his level." And also, Cap has been stated to know every style. Does he really? No, he demonstrates a few martial arts. He knows boxing, judo, has been shown to use some tae-kwon-do kicks, and also has his own very acrobatic style of fighting. Neither of these guys know every style. I would, however, put them on the same level of skill in terms of h2h.

Actually, at the end of the day, I think it would be even. Wolverine would have a mountain of an obstacle to overcome considering he doesn't have his adamantium, his healing factor, or claws. Caps just as good as Wolverine in terms of fighting. Cap might be SLIGHTLY more skilled, but Wolverine makes up for it with his experience. So let's break it down:
Experience: Wolverine
Fighting Ability: Even or Cap slightly
Durability: W/o Wolverine's healing factor, I'd say it's even
Strength: Even; I doubt Cap's a level 5, as he's never been shown to be able to lift that kind of weight. I think that would be more like Ult. Cap
Stamina: Cap
Speed: Even, maybe Wolverine slightly
Intelligence: Cap, slightly
So imo, it's pretty even.
