3) Says what? No punishment necessitates a crime... the innocent were taken away and therefore the unrepentant parents were punished and the children got heaven and no indication of suffering. A free ticket to heaven with no suffering is not punishment.
4) Free will. Hell is a necessity based on human dignity. Heaven for the saved, the rest to non-existence, Sheol is the only suffering you will have in the afterlife and it will be of your own volition, God will have nothing to do with it.

Not at all. The highest level of Roman government involvewd was the local govenor, and he was not really involved. It was mostly a Jewish revolt/political pressure.
And crucifiction was not just reserved for traitors, though it was very severe punishment..
