Thats Stingray (http://en.wikipedia.org/wiki/Stingray_%28comics%29). I noticed that DD is in the same room with Caps team as well as getting captured. I keep thinking theres more to him being caught than we think, afterall he is a big name to just go down that easily, maybe theres more to the "silver dollar" as well.

I dont think that was Daredevil at all. I think its still Iron Fist wearing DD's outfit. In Civil War: Choosing Sides, Fist told Daredevil that hed continue to wear the costume as a favor to Matt as he went out of town.

Teeechnically, DD hasnt even shown up yet. Les not forget that he was in jail for the most part and he just got out recently. When he did get out, his main priority was to find who was behind Foggy's death. He visited only a couple of people and spent some time with Iron Fist. Before he decided to go out of the country(in which he still is), Iron Fist promised to continue to do Matt the favor and wear his costume until he gets back.
I am sure tht if Daredevil was actually around, hed be on Caps side. No doubts about it.

I just finished CW #5 and I have to say it was just as good as the other 4, though it did seem like a faster read... leaving me hungry for more.I was a little worried Spidey wasn't going to be going out in a good way thanks to some people grumbling about it being more of a slaughter than a battle, but he definitely duped Stark and gave the SHIELD agents a run for their money. Being shot through shatter-proof glass and falling scores of stories is really what did him in; considering that, I don't have a problem with his whipping at the hands of a couple D-list, especially since he was hit at point blank range with an explosive and given a hallucinogen.
There are few characters- without a healing factor- that can take a beating like that, and I believe Peter is one of the toughest heroes out there, both emotionally and physically. My favorite single page was the one with Punisher holding the wounded Peter, it was beautiful.

That was Danny in the diner. I know it looks like Matt (personally I think Danny did it on purpose in case he ever got busted). The timeline in DD's book doesn't give him the opportunity to show up at the diner plus IIRC Tom B said the Daredevil we've seen in CW 1 is the new DD, therefore I think its the same Daredevil we've seen throughout the series
