By the definition of fiction TOAA is nothing but a drawing on a piece of paper he is fictional. And Mr M hasn't disputed this point with me. You can call up an English professor, call up Marvel they'll tell you the same thing.

Why do you keep repeating this? The real writer is the one giving us the story. TOAA is just the pretend writer giving a story within the comic panel.
TOAA is a drawing the artist and writer conceived to be the "writer/artist" on panel. The real artists are the ones drawing TOAA, TOAA itself is just a drawing like any other comic character, a fictional avatar of the real people behind all comic characters (TOAA being among these characters).
