Not all spells require a wand if the wizard is strong enough. Dumbles uses Arresto Momentum without a wand when Harry fell off his firebolt. A wand is more of an aiming device.
So Voldemort, from peru or wherever he's hiding, can use legilimecy, through the distance, through the many, many protective spells around Hogwarts, aiming specifically at Harry, without Dumbledore realising or having anything better to stop him then Occlumency, without a wand? And this makes sense to you?

Ok so I watched the scene again on youtube and the most it makes Harry do is grimace. Plus he's clearly moved by the end of the flashbacks so he was not incapacitated.
