Gladiator was in a blind rage, and he was getting sliced up. Also, if he's a class 50 by your definition, then you're low balling him, and we might as well put Thing in there, and he'd win.

You're using a one chance opportunity where Gladiator wasn't thinking straight. In his next appearance Gladiator was beating Darkhawk, and was rewarded the scepter.
