can i get of with self defence on these situation.

1. a masked guy run up to my car at night and i shoot him and he dies.
2. a guy is at my window at my house and is trying to break in and i shoot him through the window.
3. im in a bank and bank robber comes in to rob it and i shoot both of them.
4. i just came home from military in a bloody war against the koreans(best friend was killed) and i see a person on the street with a korean flag and he knows i was in the war and taunts me and somehow i kill him because im still delusional about the war.
5. an off duty cop pulls a gun on me and i shoot him (not knowing he is a cop)

5. yes.. if you can prove or persuade ppl the cop did not identify himself as a police officer and shot him out of self defense.

1) no, the law does not cover "wearing a mask" as a crime you can be killed for
2)probably not
3)yes probably
4)absolutely not, you can't shoot people for having Korean heritage
5) probably, if he's off duty and pulls a gun on you then its reasonable to think he wants to hurt you

By the way, this is part of the reason that people want severe gun control.

actually in some states it is illegal to wear mask in certain areas even if it is just in public..

1 - no, everyone has given reason.

2 - no, but you might get off with the fact he was breaking a crime on your property. I don't know if that is self-defense per se, and you would probably need to identify clearly that they were a criminal, and try to scare them off first before using deadly force.

3 - why do you have a gun at the bank? a world where self richous vigilantes carry guns to public places scares me much more than criminals do. Though, that matter aside, you are probably ok, provided they also had guns or weapons of some sort.

4 - no, you might "get off" with mental instability, but in that case you are admitted to a psychiatric prison, where on average, you spend way more time than you would for just admitting to murder outright. And they pump you full of the bad kind of drugs.

5 - why does he pull his gun? If it is just a random threat to you, of course you are within your rights. If he fails to identify himself as a police officer, you are within your rights, etc. The only reason you wouldn't be is if he was responding to your suspected criminal activity, which in this case, would be walking around with a gun in a public place. In which case, I hope he caps your ass.

actually a police officer responding to you with his weapon drawn b/c he sees you with a gun is also criminal on his part since he has no reason or knowledge if you have a weapons permit and license to carry..

him even approaching you and asking for such information is also illegal and unconstitional and you dont need to answer and he can be held in even more trouble if he tries to detain you with you refusing to answer which is your constitutional right.. assuming you live in a city that allows for permits and licenses..

because criminals, especially robbers, use violence in a utilitarian manner, most of the time, and have a very limited scope in the violence they do. Vigilantes do NOT use violence in a utilitarian manner. They do so in a reactive, moral manner. There is no predictability, and there is a far higher liklyhood, in my mind at least, of this person making errors and hurting innocent people.

I'm not saying criminals are less violent, I just think that I am much more likely to be shot down by some hollier than thou idiot who thinks I'm a threat, than by some criminal who wants the money in my pocket.

exactly. actually youtube has videos of ppl in a town where the majority carry guns.. its legal if you have a permit but even then cops on duty try to stop and question ppl for their I.D. and permits which is illegal.. they have this gun club where they go off and try to get cops violating their constitutional rights by asking questions and detaining ppl who refuse to answer.. just to sue or get them fired

Why not just try to get the local police better informed about the law?

I'm actually completely in favor of people, at the very least, having to justify why they have a gun in public, and being told to remove themselves if they don't have a good reason.

anyways my friend and i carry a gun.. my friend actually has a concealed wpn but he also carries it openly.

i always tell him its a bad idea since he is black and a cop might just shoot his @$$ one day while walking to his car or grocery.. but who em i to say anything i carry mine behind my back..

ok, but if he is doing this, the fact you have a gun is pointless in the first place, we are talking about rampant corruption, not carry rights for guns.

In Canada, we do have licences to carry guns, potentially conceiled, in public places. Most citizens can't get that right (maybe with pistols.... damn, I looked this up a couple of months ago...), but I see no issue with it.

However, I do support the rights of police officers to demand to see that license and also demand the person have some reason to be armed. So, if a cop comes up to you and asks to see your license, I am cool with that.

Every other thing you listed is pretty much moot with regard to that point.
