Galifinakis is one of the most unique and funniest stand up comediens who currently perform.

Bill Maher himself smoked in "Religulous", so Zach knew he'd be welcome.

Mahr's been an advocate of legalization and candidly admimitted to his use since back in the "Politically Incorrect" days, so ya, I totally agree, very low risk.

Zero risk, if authorities were to try and press charges against, him, Mahr or the studio, they need only say "it was tabacco; was just a comedic stunt".

What's the legal standing of doing that? Like can the cops do anything about it since it's on national television? (I recall that Kavorkian was arrested for comments made during an interview)

you can't be charged for use of drugs in videos anyways, the charge is specifically for possession

there is nothing illegal about admitting to authorities that you are a major heroin dealer, so long as you don't have any (it would give them probable cause to tap your phones and follow you though)

EDIT: at least in Canada

EDIT2: again from a canadian perspective (I don't know if there are smoking bans in California yet) but, he would be more at risk for a fine from smoking indoors than from possession charges, though, cops would have clear legal grounds to search him pretty much any time they wanted.
