Except if Harry won they wouldn't be interfering in the duel by attacking him afterwards. Facts are it was highly likely that Harry would be killed even if he beat Moldy Voldy. Them disbanding after he disappeared under questionable circumstances are different than this. They can't now claim they were under his spell like most of them did.
