Batman not killing is a fairly new idea (at least, relative to his history). If they were basing Affleck's version on modern Batman, then yes, it would be out of place. But they're using Frank Miller's version, which existed at a time when Batman cared much less about the lives of his villains.
I'm not saying they should have used that version at all, but they did, so like it or not that's what we get.

And Affleck in more control means we should get something special, I hope. After BvS I genuinely feel like he has a better understanding of the character than the people working on BvS.
