There's 3 distinct stories in the comics that I recall where Batman picks up a gun & uses it with the intent to kill.
1) A 3 part issue over 30 years old where Bruce begs for his dead father's forgiveness that he has no choice but to use the same gun that killed him & his mother to kill some villain. The villain wore armour & was armed with a gun in one hand & a scimitar in the other, Batman couldn't get close to him for hand to hand. Batman/Bruce justified (to a portrait of his father) that it was only fitting to use the same gun to avenge the death of his grandfather.
The front cover even had an image of Bats looking grim holding the pistol.
2) When 2 genetically modified soldiers are on the run in Gotham & threaten to unleash poisonous spores in the water, Batman uses a magnum to shoot & take them down.
3) As I already pointed out, in Miller's TDKR, Batman uses a big ass gun to shoot the Mutie holding the baby.

The baby is kidnapped & held for ransom by the Mutants who are armed with stolen military weapons.
One mutie wants to flush the baby down the toilet to stop it from crying, regardless of the ransom.
A noise at the door causes the muties to fry at it only to reveal a bat flying through the doorway. Big mutie shoots little mutie because he was in the way of the crossfire & big mutie shrugs it off.
Batman appears. Picks up gun dropped by dead mutie & points it at Big mutie holding the baby.
Big mutie's screaming, "Drop it drop it or I'll shoot the baby!"
Bats say, "I know." And pulls the trigger blasting big mutie through the wall & catching the falling baby.
It's in the comic of TDKR & also in the animated version.

The characters don't have good motivations for their actions. Period. Nothing in this movie is earned. Everything happens at such a blistering pace because:
A) They're trying to fit 3 stories into 1
B) They're racing to establish their universe to catch Marvel.Neither one of those are a good idea. It's one of the big problems with the film; among many, many others. It's earned the bad scores.
