The lawsuit was about the harmful handling of the story such that it resulted in death threats, ostrization, and the inability for his entire family to do anything because of the mobs - all based on deliberate lies.
This is a lawsuit of libel, not a criminal suit. What does the person - who lied about his military record - have anything to do with feeling threatened by a smirking stick? It wasn't about Philips or the little shit. It was about the libel and the fallout from that libel. There was clear maliciousness in the story and I called within a day of this situation happening - noticed that the video seemed odd and did not show what lead up to the confrontation (and that Philips was beating the drum rather aggressively in the dude's face). I had to scour the internet the next day to find the full 45 minute video. Turned out, I was completely right about every detail.
