I do get the 3rd degree charge, that's easy to prove with the video as evidence and will likely lead to a guaranteed conviction. Proving the cop was trying to kill the man is much harder, especially since he died later on.

I think the 3rd degree manslaughter charge is fitting. Only because he was in cuffs and not struggling.
To put it into perspective, 3rd degree murder/involuntary manslaughter is a fairly tame charge. He could actually get a "time served" or up to a 20,000 fine for this when the case is all said and done.
