Well anyway, it is almost certain that S.H won't be tried by an international court, given the fact the US doesn't recognize such institution (or it could create its own, but its impartiality would be questionable ; moreover this action would disavow the Iraqi government)
Of course he CAN protest, GP. But as I said, he can do that WHEREVER he is tried. So long as he is allowed to speak, and it would be impossible for him not to, he could raise such complaints.
So the venue of Court would not be based on the risk of him speaking out so.
As to the second point, I agree; the US would not use an International Court they do not support.
