The rules state that Achievements shall be judged within the parameters defined by the Visual Effects Branch Executive Committee and on the basis of:
(a) consideration of the contribution the visual effects make to the overall production and
(b) the artistry, skill and fidelity with which the visual illusions are achieved.
So they wont judge the film just on one particular scene, but on the overall impact the VFX had on the film, and also the skill with which they were used.
But is also says that: Visual Effects, as an achievement or a craft, shall be determined by the Visual Effects Branch Executive Committee. Eligibility of the contributor(s) to the achievement, for nomination purposes, shall be determined by the Visual Effects Branch Executive Committee.
So, unless we can find out exactly what the Visual Effects Branch Executive Committee determines as 'visual effects', it is hard to decide at this point which film is likely to take it out.
There is NO award for best Special Effects, I think it all comes fown under this category, though, at least in recent years, I think the consensus is the 'visual effects' are doen in post production, and not practical effects on the set. Though I could be wrong about that since these rules don't explain it.
If it does include ALL special effects then I think Batman Begins is definitely in with a chance. It had terrific special effects, though much of it was done on set. I think it had an excellent balance between visual and practical effects...

There's still much proof that ILM's talent is equal to WETA's. I saw War of the Worlds last night, and the effects were incredible. This is also proof that ILM can achieve hyper-realism.
The Star Wars prequels' effects are supposed to look stylized as opposed to realistic. If Lucas and ILM were going for realistic, it would have shown.
In a nutshell, ILM can achieve realistic effects and the SW prequels are intended to look how they do.
