I don't think lack of oxygen contributed to Ben's loss much at all. He did his best at that point by knocking his helmet off.
And in the Namor fight he was fighting rather well in the water, sh!t he even won.

just saw this on gillens formspring...Interesting a hell lord and an avatar of Cyttorak with the pf force...knowing marvel, they will just blow it and have the same power as the other 3 much weaker x-men. hopefully gillen covers it in uncanny...

Where was this stated? All of the members of the Phoenix five appearances are different. There is nothing indicating he isn't using that power, especially going by Cy words.
