Absolutely. I was shocked to see BP in the second tier to be honest. But this doesn't change how I feel about the remaining characters in the same tier.

Well for one I think some people should be moved up first. I don't find Punisher more skilled than Psylocke.. especially now after her ogun training. I'd say that Punisher's definitely somewhere at the top of his tier but they need to be adjusted before he could be moved up.

That didnt answer the question. Just because other people arent were they should be is no reason why he shouldnt be 2nd.

Why so? Did you read my argument? Considering the people hes fought and beat compared to those in a tier higher and havent done as much as he in terms of h2h.White Tiger and Red Skull. White Tiger whos a tier higher and someone who has hardly any fights/feats. Red Skull whos also a tier higher and someone who Fisk beat in a pure h2h confrontation.
Also, does Red Skull have the tracklist of skilled combatants hes fought and beat as Fisk? Just asking. I know for a fact that White Tiger doesnt.

because of their power sets, the fighting/MA experience they have is over shadowed, they have to have fought against another top Martial artist and give an admirable display, however they won't really get the chance, becuase herc is all about Smashing/lifting/throwing and wrestleing, and Thor is all about Blasts and a hella lot of Mjolnir.

because this entire thing seem to be based on bias liking of character. They moved friggin cyclopes to third even though there people like falcon in the 4th tier who would kick his ass in h2h. Hell storm even beat cyclopes becuase she was a better fighter before.
