Well, the people in that tier define who deserves to be in there. If someone more deseverving than others is discovered or w/e, then the least deserving person is put down to tier 2.
So if you want a character pushed up, you have to prove why they are more deserving of top tier than another character...

Were you the one saying that most of Caps MA skill comes from the SSS? Anyway BP back in the day (when he wasnt superhuman) was too fast against Cap while injured.

I don't think NW is up there with the likes of Batman etc. In my view he is at the very top of second tier.
Prometheus when he uses his gizmos was good enough to floor Shiva I'm sure. Though as Phantom said, using him might not be the best idea in this case.
