Anyone. There's various criteria, like number of posts and time as a member on KMC, but regulars to the forum are welcome to vote. It's not just participants.

Participants are required to vote.

Non-Participants can vote if they have 1000 posts or more on KMC.

No, but the threat is not well received. No host has ever threatened to nullify votes, and we do not like the implication.

I was dabbling in semantics. 😛 My plan was plausible, if only due to a literal interpretation of terms.

And seriously, no host ever does that. It may be a joke, but the idea is scary. And unpredented on KMC.
