If the sentence is the same for a rapist as a rape liar, then by the same should apply to someone who commits assault and/or murder compared to someone who advocates it. People have been criminally prosecuted for manslaughter over encouraging people to commit suicide. But it varies from state to state.

Well the fire thing...the example is used to describe saying "Fire!" when you know there isn't one I thought.

I personally don't think speech = action in every circumstance is fair, it depends on the context for me, but you have your opinion and seem to hold it across the board regardless of circumstance, so props. The "shouting fire" thing is a good example of how free speech doesn't cover using language to create an action.
