Bautista apparently said that if Disney doesn't use Gunn's script he's going to try and quit the project.
“Nobody’s defending his tweets, but this was a smear campaign on a good man,” Bautista said. “I spoke to Chris Pratt the day after it happened and he’s a bit religious so he wanted time to pray and figure it out, but I was more like: f*** this. This is bullshit. James is one of the kindest, most decent people I’ve met."
“Where I’m at right now is that if [Marvel] don’t use that script, then I’m going to ask them to release me from my contract, cut me out or recast me," Bautista said. “I’d be doing James a disservice if I didn’t.”
I think Disney may end up rehiring Gunn in the coming months. In fact, I'll just go ahead and predict it now.
They don't actually care, it's just a phony outrage campaign. The worst thing that will happen is some cries of hypocrisy towards Disney. But really, who cares? No one who was planning on seeing GotG 3 will suddenly decide not to if Gunn is brought back. There's more actual outrage on the side that wants Gunn back than the side that wants him gone.

Getting a great movie, plus the hypocrisy of the left on full display would be worth it IMO.

And yep, 90% of them don't truly care. It's more about wanting to turn the tactics of the left against them. Which was going to happen sooner or later anyways if this outrage mob shit didn't stop, even without Mike Cernovich out there.
As for if Disney will indeed hire him back? Not sure. It feels like if they were seriously entertaining that idea it would have happened already. There is no real chance of just waiting out the controversy, cuz the second they hire Gunn back will just reignite it all again.
Is there a way for them to use Gunn's script without having Gunn direct? Not sure on the legalities, etc. If so, that sounds like the best compromise they could hope for. Though that in itself would be hypocrisy, given if they are willing to use his script why not just have him direct?
Also no offense to Batista, but he IS replaceable.
Replacing Bautista would be stupid for Disney to do, it would throw off the team/cast dynamic that so clearly works for this franchise.
Having said that, he's under contract, so him asking to be replaced, recast or killed off is just that, him asking. Disney only need say "no" and he can go "well, I tried".

Iger has been on vacation since the whole Fox deal was finished up, and so he's been very hands off during this. Apparently, and these are rumors, mind you, but apparently, he will be making a personal decision about the Gunn situation when he comes back from vacation in the next month or so. Essentially Iger could simply veto the previous decision and say "nah we're bringing him back, this cluster**** isn't worth the trouble." And then just deal with the 2 or 3 days of pretend anger that would ensue from those who are pretending to care, before they get distracted by the next shiny thing they can pretend to care about.
Also yes they can use Gunn's script, Disney owns it. However, if they use it they will have to credit him as a writer, his name will still be on the project.

I'd read about this too, but it was before we got additional reports that he wasn't gonna be brought back.
I get the guy is on vacation, but it seems like a conference call could have settled this really quick. No doubt Iger has been hearing about this for weeks.

However, they can't make any actual offers to him until his exit from Disney is complete, which it is not.
Some experienced talent reps estimate that due to the unique situation, Gunn could receive a payout of $7 million to $10 million, if not potentially higher. And, more importantly, he would be free to take on another project immediately. Also affecting the negotiations is that sources say Disney plans on using Gunn's script for the third movie.
