I think, but it gets better...like a week or so before this incident a letter was sent to him with crushed up aspirin in it...making it seem to be threatening him. That didn't garner much attention, then he did this.
If the letter thing was him...you get into federal crimes then, like mail fraud. That is where he might serve actual jail time if found guilty. The other stuff he'd probably get off on probation.

Mail fraud is federal crime, I don't think faking a hate crime is. While the latter I think technically could result in jail time he most likely would have gotten just probation.

If it is a crime, the fact that he planned it with the other two guys could add a criminal conspiracy charge. as all that takes is for two or more people to plan to commit a crime.
