A woman can abort her 12 week fetus and it's not a crime; if a drunk driver were to hit her and kill that same fetus say while she was on her way to the abortion clinic, 'he' could be charged with manslaughter, besides wreckless endangerment, DUI, etc. That sound right to you?

On an additional note the brain itself doesn't "feel pain," and in fact doesn't feel anything ever, since it lacks sensory ability in and of itself.
