Sorry, but Bauer is a trained espionage agent who had the skills and proper cover story to fool her. See, that's one thing you forget. There's a reason she kissed him. Remember the last time they met in Day 2, Jack had to be held at gunpoint to be stopped from driving away with Nina and executing her. That's why she felt she had to get the pardon to murder him, because she knew Bauer was going to kill her once they got the info. So it's quite obvious he hates her with every fiber of his being. So the fact that he is willing to kiss her tells her that he really has lost all will to live, and allows her to believe his cover story. Of course, this is truly because because Jack is a badass mofo who skullcaps her about 4 hours later, but yes, as you stated, it can be attributed to "Bauer's Awesomeness". Jack has the CIA training to conduct undercover operations and the willpower to kiss the person who took away the person he loved.
The main lesson of this is that Nina's mistake can be attributed to Bauer's skills in espionage more than her own slip-ups. Even if she did make a mistake, it was logical one that even the best of villains could have been slipped up by.
I admit there is some stupidity from characters, but nowhere NEAR the level of illogical shit that happens in Die Hard. What kind of retard has McClane disarmed but doesn't pat him down to grab the pistol on his back? Marwan scanned the hell out of Behrooz as soon as they intercepted him. They did that with everyone they captured. So did Gaines, and Ali, and, well, everyone. It's common logic to do a pat down. Even the stupidest 24 villains did this. But not in the DHverse, where "exceptional thief" Hans doesn't even follow this basic tenet. What kind of...well...amateur does this? Probably the same amateur who hires gunmen who, when they have McClane in a completely defenseless and distracted position, don't kill him immediately. The main point I'm making of all this and the reason I am asserting the stupidity of the DH villains is to show that Bauer is placed in far more dangerous, perilous, and intense situations than McClane has ever encountered on his worse day. McClane's adversaries are just...well....retarded amateurs, in comparison the threats to global civilization Bauer takes on in a daily basis.
