becuase I dont believe he belongs for MA ability.

Nope I am against at the moment, but may change my vote if many of the second tier guys dont end up getting dropped down.

for punisher to second, his fights with daredevil did it for me

Ok heres a couple more. The guy hes fghting has beaten Black panther, held his own against Spiderman and beaten the human torch.

Punisher vs. Daken

Punisher is already wounded after fighting the Hoods men the previous night and has a broken leg.

Against Gorgon to uber.

Putting words in my mouth aside, it would be quite hilarious to bring up a character from a superior tier being at the same level with one from an inferior one, and thus the latter's movement being justifiable, when at the same time we have more than a dozen characters moved down from a tier just so that one, Superman, can't move up.
